1. Introduction

By adding kyuri (the "Application") to a server or interacting with its features, you agree to comply with these Terms of Service ("Terms of Service," or "Terms"). These Terms govern your access to and use of the Application. If you do not agree to these Terms, you are not authorized to use the Application and must remove it from your server immediately.

These Terms apply to all versions, editions, releases, test builds, beta programs, and derivative variants of the Application, unless otherwise explicitly stated.

2. Eligibility and Compliance

You must be at least 13 years of age (or the minimum age of digital consent in your country) to use the Application. By using kyuri, you represent that you meet this requirement.

Furthermore, you agree to comply with the Discord Terms of Service and Discord Guidelines. Any violation of Discord's platform policies while using the Application may result in a permanent ban from our services.

3. Acceptable Use Policy

To maintain the integrity of the service, you agree not to engage in the following:

  • A.API Abuse: Any attempt to flood, spam, or otherwise stress the Application's infrastructure through automated scripts or "self-bots" is strictly prohibited.
  • B.Malicious Intent: Using the Application to distribute malware, phishing links, or to facilitate the harassment of other Discord users.
  • C.Circumvention: Attempting to bypass server-specific blacklists or global user bans imposed by the developer.

4. Intellectual Property

All code, branding, and original assets related to kyuri are the intellectual property of @imkazi. You are granted a limited, non-exclusive, non-transferable license to use the Application for its intended purpose within Discord. You may not reverse engineer, decompile, or redistribute any portion of the Application's logic or assets without explicit written consent.

5. User-Generated Content

By submitting content to the Application (including but not limited to custom commands, profiles, or media), you grant @imkazi a worldwide, royalty-free license to host, store, and display such content solely for the purpose of operating the Application. You represent that you own or have the necessary rights to any content you provide.

6. Termination

We reserve the right to terminate your access to kyuri at any time, for any reason, including but not limited to violations of these Terms. Termination may be applied to individual users or entire Discord guilds at our sole discretion.

7. AI Training and User Consent

Certain features of the Application may involve the collection and processing of Discord messages and related interaction data for the purpose of improving artificial intelligence and machine learning systems associated with the Application.

Participation in any AI training, feedback, or dataset collection program is strictly voluntary and requires explicit user consent prior to participation. Users participating in such programs may be required to sign a Non-Disclosure Agreement ("NDA"), consent form, and age verification acknowledgement confirming they are at least 18 years of age.

Users who do not explicitly opt into these programs will not have their messages intentionally used for AI training purposes beyond what is operationally necessary to provide the Application's core functionality.

We reserve the right to remove, anonymize, aggregate, or exclude submitted data from training datasets at our sole discretion in order to maintain safety, quality, legal compliance, and platform integrity.

8. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee that the Application will be uninterrupted, error-free, secure, or free from harmful components.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application.

This includes, but is not limited to, loss of data, loss of profits, service interruptions, unauthorized access, or damages resulting from the third-party actions.

10. Changes to These Terms

We reserve the right to modify, update, or replace these Terms at any time to reflect changes in the Application, legal requirements, or operational practices. Any updates will become effective immediately upon publication unless otherwise stated. Continued use of kyuri after changes are published constitutes your acceptance of the revised Terms.

In the event that these Terms are updated/modified, the Last Updated flag at the top of this page will be updated accordingly. It is your responsibility to continually check up on these Terms for any updates/modifications.
